Transactional

Our attorneys work with clients in drafting, reviewing, and negotiating construction-related contracts for various types of projects involving many different  construction delivery methods. The group has developed an extensive database, taking industry-recognized standard forms (such as AIA, Consensus Documents, OFCC, and EJCDC documents) and creating contract documents tailored to the individual needs of our clients and the particular needs of the project. Our team works proactively with clients to mitigate risk by ensuring that appropriate contracts are put in place before a project begins. Litigation/Dispute Resolution

When disputes do arise, our construction litigators work with clients to resolve claims involving project delay, cost over runs, scope changes, construction defects, design defects, warranties, project management, and claims involving catastrophic injuries and property damage. Our team has litigated disputes involving the simplest issues on residential projects to multi-faceted, complex claims on commercial and public projects. In the same arena, our team deals with insurance issues that arise on projects and has represented prominent sureties in managing complex bond claims. We also have extensive experience in perfecting mechanics liens and pursing claims on liens in order to ensure contractors, subcontractors and material suppliers are paid for their efforts.

Our construction litigators have resolved cases through a wide range of dispute resolution mechanisms. Where possible, our attorneys will represent clients in working collaboratively with all parties in order to seek resolution of project issues before the issues get to the point of formal claim resolution. In the event claims do arise, our attorneys are experienced in handling negotiation and resolving claims through mediation and, if need be, through a final adjudication in arbitration or litigation. Our construction litigators have tried cases in AAA arbitration, states courts in Ohio, Kentucky and other jurisdiction as well as in federal courts.
